REGULATION (EC) NO. 1907/2006 REACH
OF THE EUROPEAN PARLIAMENT AND COUNCIL
On 1st June 2007 the European regulation entitled REACH (Registration Evaluation Authorisation of CHemicals) entered into force. REACH is a regulation aimed at all manufacturers of chemicals, based in the EU, at importers importing chemicals into the EU, as well as at all companies using or handling chemicals. This European regulation is binding on all EU member states as domestic law without any further implementation.
This regulation is directed primarily to manufacturers and importers of chemicals. It is the aim of REACH, however, to include the entire sales chain. As a result, REACH also affects companies that use chemical substances in the broader sense, in other words virtually the entire manufacturing industry. In the regulation the latter are referred to asdownstream users.
REACH demands that manufacturers and importers register all chemicals as raw materials, in preparations/mixtures and products, in as far as more than 1 ton of these are produced or imported per year (t/a). Preparations (mixtures of various substances, such as paints, varnishes) and products that themselves release chemical substances (e.g. computers, electrical devices) need not be registered.
Graduated according to the annual quantity produced, manufacturers must supply more exacting data records. They must decide for what purposes they want the substance to be authorised and what responsibility they want to assume for its safe handling. Manufacturers and importers must draw up and keep a Technical Dossier on all substances which they produce or import in a quantity of > 1 t/a. This dossier must describe the basic properties of the substance, its classification and labelling as well as the use and guidelines for its safe handling. As from 10 t/a an additional Substance Safety Report must be submitted, stating the hazard potential for human beings and the environment.
The manufacturers and importers pass on this substance information to all their customers, the so calleddownstream users.
Declaration:
Within the meaning of REACH in accordance with article 3 no. 13, Dewert Antriebs- und Systemtechnik GmbH is a”downsteam user“, who within the scope of its business opera-tions uses a substance as such or in a preparation.
The quantities of chemical substances used by Dewert Antriebs- und Systemtechnik GmbH and which are possibly governed by the REACH regulation, lie well below the above mentioned threshold value of more than 1 ton per year per manufacturer and as such are not subject to registration by Dewert Antriebs- und Systemtechnik GmbH within the meaning of REACH.
